FCC dismisses 14 Robert Lund applications

The Audio Division has dismissed 14 applications, mainly in rural Oregon that were "assisted" by Robert Lund.  These applications were the subject of objections made by Prometheus Radio Project and other parties. 

In all of the cases reviewed by REC, the FCC dismissed the applications because while the organization may have formed a corporation in time of the application filing, the corporation was no longer recognized by the state.  This is usually due to the failure for the corporation to file an annual report. 

Citing §73.853(b), the FCC states that corporations are required to remain eligible at the time of filing and "at all times thereafter".  

In the Prometheus' objection, many of the similarities between the applications were noted including the many family members with the Lund surname that were used as the parties to applications in many cases.  

The FCC did not specifically address the Informal Objections as they found cause to dismiss the applications for other reasons. 

REC has filed a supplement to our informal objection against several Cesar Guel assisted applications because the corporate status of the applications were forfeited by the State of Texas.    We are hoping that the Commission will soon take action on the Cesar Guel informal objection. 

Lund did end up with one station in Hawaii, KKFJ-LP, Kailua-Kona which includes in the officers, a William Lund and a Lisa Lund giving an address in Hawaii and a Joshua Lund from Sweet Home, OR.  This station has not yet covered their construction permit. 

REC reminds all applicants, permittees and licensees to assure that they are filing their annual reports with their state commissions in order to maintain their non-profit corporate status in their state.
